TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Growler Aviation website, including any content, forms, and related services (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Definitions

“Growler Aviation,” “we,” “us,” and “our” means Growler Aviation.
“You” means the individual or entity accessing or using the Site.

2) Use of the Site

You may use this Site for lawful purposes only. You agree not to:

  • misuse or interfere with the Site’s operation;

  • attempt to access the Site’s systems without authorization;

  • submit false, misleading, or fraudulent information;

  • use the Site to harass, threaten, or abuse any person;

  • scrape, copy, or reproduce the Site’s content for commercial use without permission.

We may restrict or terminate access to the Site at any time for any violation of these Terms.

3) Informational Purpose Only (No Offer)

The Site is provided for general informational purposes. Nothing on the Site constitutes a binding offer to provide services, and no statement on the Site modifies or replaces any written agreement signed by Growler Aviation and a client.

4) No Guarantee of Availability or Timing

Operational aviation services depend on many variables outside of Growler Aviation’s control, including weather, maintenance, crew scheduling, airspace restrictions, permit approvals, airport/FBO operating limitations, and government processes.
We do not guarantee availability, routing, scheduling, turnaround time, or outcomes unless confirmed in writing.

5) Quotes and Services

Any quote, estimate, or schedule discussed through the Site or by email/phone is non-binding unless confirmed in writing by Growler Aviation. A signed agreement may be required before services begin.

6) Client Responsibilities (If Services Are Requested)

If you request ferry or operational coordination services, you acknowledge that you (or the aircraft owner/operator) are responsible for:

  • ensuring the aircraft is airworthy and legally operable;

  • providing accurate and complete documentation and information;

  • maintaining required hull and liability insurance as applicable;

  • complying with all applicable laws, regulations, and operational limitations.

7) Third-Party Providers

Growler Aviation may reference or involve coordination with third-party services such as fuel providers, FBOs, ground handlers, hotels, and transportation. Growler Aviation is not responsible for third-party performance, availability, delays, or pricing changes.

8) Intellectual Property

All content on this Site, including text, graphics, designs, logos, images, and layout, is owned by Growler Aviation or licensed to Growler Aviation and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or create derivative works from our content without our written permission.

9) No Unauthorized Use of Branding

You may not use our name, logo, branding, or trademarks in any advertising, publicity, endorsements, or marketing materials without written authorization.

10) User Submissions (Contact Forms, Messages, Uploaded Documents)

If you submit information through the Site (including contact forms or messages), you represent that:

  • the information is accurate to the best of your knowledge;

  • you have the right to provide it;

  • it does not violate any law or third-party rights.

You grant Growler Aviation permission to use submitted information for operational purposes such as responding to your inquiry, preparing a quote, or coordinating requested services.

11) Confidentiality Warning (Internet Communications)

Communications sent through the internet (including web forms and email) may not be fully secure. Do not submit sensitive information unless it is necessary for operational purposes. We are not responsible for interception, unauthorized access, or transmission failures outside of our control.

12) Disclaimers of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWLER AVIATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND AVAILABILITY.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWLER AVIATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO:

  • YOUR USE OF (OR INABILITY TO USE) THE SITE,

  • ANY CONTENT ON THE SITE,

  • ANY INQUIRIES, QUOTES, OR COMMUNICATIONS INITIATED THROUGH THE SITE,
    EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE SHALL NOT EXCEED $100.00 USD.

14) Indemnification

You agree to defend, indemnify, and hold harmless Growler Aviation and its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Site;

  • your violation of these Terms;

  • your violation of any law or third-party rights;

  • any information you submit through the Site.

15) Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought in the state or federal courts located in Nevada, and you consent to personal jurisdiction in those courts. 16) Changes to These Terms

We may update these Terms at any time. Updates are effective when posted on this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
